It’s not clear if either hearing date was advertised in this case. Regardless, there is a requirement to timely advertise the original hearing date, or else to advertise the new one if the original date has passed and was not advertised. ![]() New Jersey Statute 40:49-2 addresses the issue of legal notice for ordinances and is quiet on this point. A question is whether there is a requirement to re-advertise the new date for a hearing that was tabled at the meeting when it was initially scheduled to occur. Ordinance 2018-02 was initially scheduled for Mathen tabled to March 28. If not, action on the Ordinance should be tabled pending legal notice so that the public has an opportunity to meaningfully participate. It’s not clear if notice of the hearing was properly advertised, however. UPDATE(): The second reading - and public hearing - for Mansfield Ordinance 2018-02 is on the agenda for tonight’s Township Committee meeting (). UPDATE(): The hearing was tabled due to not being properly advertised. Ordinance 2018-02 is scheduled for at 8 PM per the public notice available online here. UPDATE (): The second reading and public hearing for new Mansfield Twp. Committee adopted Ordinance 2018-02 by a vote of 4 to 1.
